Important: These Terms form a legally binding agreement between you and BotKavach. Please read them carefully, especially the sections on Acceptable Use, Subscriptions & Billing (including Chargebacks), Refunds, Disclaimer of Warranties, Specific Service Limitations, Limitation of Liability, and Governing Law & Dispute Resolution (including the arbitration and class-action waiver).
These Terms of Service ("Terms") govern your access to and use of the BotKavach website and services (collectively, the "Service") provided by BotKavach ("BotKavach", "we", "us", or "our"). By registering an account, accessing, or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy and Refund Policy. If you do not agree, you must not access or use the Service.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must be at least 16 years old and legally capable of entering into binding contracts to use the Service. You agree to provide accurate, current, and complete information during registration and to keep it updated.
You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use or security breach. BotKavach will not be liable for losses caused by unauthorized access.
Subject to your continued compliance with these Terms and payment of applicable fees, BotKavach grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business purposes during the subscription term.

Violations may result in immediate suspension or termination of your account, without refund, and may expose you to legal liability.
Paid Plans are billed in advance on a recurring monthly or yearly basis, depending on your selected billing cycle. Fees are charged automatically through your payment method on file at the start of each billing period.
If you initiate a chargeback or payment dispute with your bank or payment provider for a valid BotKavach charge, your account shall be immediately suspended pending review. All chargeback disputes will be reviewed by BotKavach. If the chargeback is deemed invalid or fraudulent, access may be reinstated within 7 business days upon resolution, provided the disputed amount is repaid. Repeated or abusive chargebacks may result in permanent account termination without refund and may be reported to payment-processing fraud databases.
Before initiating a chargeback, you agree to first contact BotKavach support at support@botkavach.com to attempt to resolve the dispute. Initiating a chargeback without first contacting support is a material breach of these Terms.
We may offer free trials for a limited period. Trials allow you to evaluate the Service before paying. At the end of the trial, your selected Plan will begin and your payment method will be charged unless you cancel before the trial ends. Unused trial time is not refundable and carries no cash value.
All payments are non-refundable. Our complete refund policy is set out in our Refund Policy, which is incorporated into these Terms by reference.
You retain ownership of all content and data you submit to the Service ("User Content"), including campaign configurations, target URLs, and rules. You grant BotKavach a worldwide, non-exclusive license to process your User Content solely as necessary to operate and improve the Service.
You represent that you have all necessary rights to your User Content and that it does not violate any law or third-party right. BotKavach may suspend processing of any campaign that we reasonably believe violates these Terms.
The Service, including its software, design, detection logic, branding, and documentation, is the exclusive property of BotKavach and is protected by intellectual property laws. These Terms grant you no rights to our trademarks, logos, or proprietary technology except as expressly stated herein.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BotKavach DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
BotKavach DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL DETECT OR BLOCK ALL FRAUDULENT OR UNWANTED TRAFFIC. DETECTION ACCURACY IS NOT GUARANTEED. YOU USE THE SERVICE AT YOUR OWN RISK.
This Section 12 sets out specific limitations of the Service that supplement the general Disclaimer of Warranties above. These limitations are material terms of your agreement with BotKavach.
BotKavach is a traffic-filtering, visitor-scoring, and page-routing tool. It inspects visitors after they arrive at your tracking URL and decides, based on rules you configure, whether to show them your real page or a safe/block page. It is not an ad-platform integration, a billing control, or a refund-recovery system.
Advertising platforms such as Google Ads, Meta, Microsoft Ads, TikTok, and others bill for clicks at the time the click occurs, in real time, before the visitor reaches your landing page. BotKavach operates after the click has already been billed. BotKavach does not, and cannot:
Any marketing language referring to "saving," "recovering," or "stopping" wasted spend describes the filtering of unwanted visitors from your landing page, not the prevention or reversal of ad-platform charges.
No traffic-filtering system can detect or block all invalid, fraudulent, bot, or unwanted traffic. BotKavach uses best-effort detection methods including device fingerprinting, IP reputation, TLS fingerprinting (JA3/JA4), VPN/proxy detection, behavioral analysis, and machine-learning risk scoring. The user acknowledges that:
The user is solely and exclusively responsible for ensuring that their use of BotKavach, including any cloaking, page-switching, or traffic-filtering behavior, complies with the terms, policies, advertising guidelines, and acceptable-use rules of each platform on which they run traffic. BotKavach is not affiliated with, endorsed by, sponsored by, or in partnership with Google, Meta, Microsoft, TikTok, or any other advertising network. BotKavach does not guarantee ad approval, account safety, or compliance with any platform's policies. The user accepts full responsibility for any consequences arising from their use of the Service with any ad platform, including but not limited to ad disapproval, account suspension, or account bans.
BotKavach may generate forensic logs, click dossiers, CSV/JSON exports, or reports about blocked visitors. These are provided for the user's own transparency, record-keeping, and internal analysis. They are not represented as, nor guaranteed to be:
The user acknowledges that ad platforms make their own independent determinations regarding refund or credit requests, and BotKavach has no control over those determinations.
BotKavach is designed to be installed on the user's own server or hosting environment. The user is responsible for:
BotKavach is not responsible for losses arising from the user's hosting environment, server configuration, or failure to maintain the software.
BotKavach includes functionality to display different pages to different visitors (commonly called "cloaking"). This feature is provided as a neutral tool. The user is solely responsible for the content of their safe pages and real pages, and for ensuring that any page-switching behavior complies with applicable laws and the policies of any platform whose traffic they route through BotKavach. BotKavach does not encourage, endorse, or assist with any deceptive or policy-violating use of cloaking functionality.
There is no guarantee that you will save any money using the Service. Any examples, statistics, percentages, or savings figures referenced on the BotKavach website, marketing materials, or documentation are illustrative only and are not to be interpreted as a promise or guarantee of savings. Savings potential, if any, is entirely dependent on the user's traffic sources, campaign configuration, filter settings, and business decisions. No express or implied guarantees of income, revenue, ROAS, or return on investment are made when purchasing the Service. You agree that BotKavach is not responsible for the success or failure of your business decisions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BotKavach, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY.
BotKavach's TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO BotKavach IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $500.
You agree to indemnify and hold harmless BotKavach and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your User Content, your violation of these Terms, or your violation of any law or third-party right.
You may cancel your account at any time through the dashboard. We may suspend or terminate your account immediately, without notice, if you breach these Terms or if we believe your use poses a risk to the Service or others.
Upon termination, your right to use the Service ends immediately. No refunds are provided for partial billing periods. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer, Limitation of Liability, and Indemnification) shall remain in effect.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which BotKavach is established, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the competent courts of that jurisdiction for any dispute arising from these Terms, except where prohibited by mandatory consumer-protection law.
Any dispute arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations between the parties. You agree to contact BotKavach at support@botkavach.com and provide a reasonable description of the dispute before initiating any formal proceeding.
If a resolution cannot be reached through negotiation within thirty (30) days, the dispute shall be submitted to binding arbitration rather than litigated in court. The arbitration shall be conducted in accordance with the rules of a recognized arbitration body to be determined by BotKavach based on the user's location. The arbitrator's decision shall be final and binding and enforceable in any court of competent jurisdiction under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
You expressly waive your right to a trial by jury and agree that arbitration shall be the exclusive remedy for all disputes arising out of or related to these Terms or the Service. You further waive your right to participate in any class-action lawsuit or class-wide arbitration against BotKavach. Any claim must be brought in the user's individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
Notwithstanding the foregoing, BotKavach may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidentiality, or other proprietary rights without first submitting to arbitration.
We may revise these Terms at any time. Material changes will be communicated by email or a dashboard notice. The "Last updated" date indicates the latest revision. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
